The Terms and Conditions of Use for myAIS Application

Terms and Conditions for using myAIS ("the Terms and Conditions") apply to AIS mobile phone Subscribers, Fixed Broadband Service Subscribers such as AIS Fibre high-speed internet service, and other general Subscribers who register and use myAIS in accordance with the specified Terms and Conditions. 

The Terms and Conditions define the details, procedures, rights, and responsibilities for using myAIS. The Subscriber is recommended to thoroughly read and understand the Terms and Conditions before agreeing to access and use myAIS.

The use of myAIS service is solely performed under the Subscriber’s desire, and the Subscriber willingly accepts and complies with the Terms and Conditions. In case the Subscriber desires not to accept the Terms and Conditions, Subscribers will not be able to access myAIS.

The Terms and Conditions may be modified or amended to ensure compliance with relevant laws or regulations. If any modifications or amendments are made, notification will be provided through the myAIS Application or by other specified methods. Subscribers agree to comply with any additional terms and conditions until decide to discontinue the use of myAIS.

1. Definitions
"myAIS"
means the application provided by the service provider as a platform for Subscribers to access information related to mobile phone services within the AIS network, AIS Fibre, and any additional services that may be offered in the future. myAIS offers the following functionalities as follows:

1. Check and access Subscriber’s information related to the use of mobile phone services under AIS network or high-speed internet service such as AIS Fibre, or any additional services that may be offered in the future.

2. Purchase products or services, register for services, modify service subscriptions, or cancel services related to mobile phone services within the AIS network, AIS Fibre, or any additional services that may be offered in the future, as well as products or services from other service providers that have been allowed to be presented on myAIS.

3. View promotional packages or privileges of various services. Using these privileges to redeem points for products and services listed on myAIS.

4. Access other services that may be added in the future.

“Computer System” means the equipment or set of equipment interfaced by a command, set of command, or other similar nature, and the code of conducts to process the data which are used with the design of myAIS application and service.

“Subscriber” means the individuals who are either Subscribers or present themselves as Subscribers of AIS mobile phone, including both postpaid and prepaid, Subscribers of AIS Fibre high-speed internet service or other services that may be introduced in the future. It also includes individuals who use and hold mobile phone numbers registered to other individuals or those who access myAIS using a user account (myID) along with their unique identification code. General individuals who agree to be bound by the Terms and Conditions to conduct electronic transactions or other activities through myAIS are also considered as Subscribers.

“Service Provider” means Advanced Wireless Network Company Limited as the provider of AIS Mobile Phone Service, and MIMO Tech Company Limited as the developer and the owner of myAIS Platform, including any related services of Service Provider and any other related services which integrated its service with this myAIS service.

"myID (User Account)" means a user account, which is created by a phone number, an internet service number, an email address, or a social media account, selected by the Subscriber to use in conjunction with a PIN to access myAIS and conduct electronic transactions or perform other activities on myAIS.

"Personal Identification Number (PIN)" means the set of numbers or numeric characters created by the Subscriber to be used in conjunction with myID, which may be in the form of a 6-digit Number or other formats as may be specified by the company in the future.

"One-Time Password (OTP)" means a single-use password, in the form of letters, characters, numbers, or other symbols generated by myAIS and sent via SMS to the Subscriber's chosen communication channel to access (log in) myAIS, establish a relationship, and confirm the registration, access, or electronic transactions of various items on myAIS that Subscribers of myAIS may perform or electronically sign their own electronic transaction.

2. Once the Subscriber has completed the specified steps in myAIS, the Subscriber will be able to access the information related to the Subscriber’s Mobile Phone Service, AIS Fibre high-speed internet service, or details about various products and services within myAIS.

Subscribers who are not AIS Mobile Phone Service Subscribers, AIS Fibre high-speed internet service Subscribers, and/or Subscribers to any related services of the Service Provider may not be able to access certain types of services on myAIS.

3. If the Subscriber requests to access the information including purchasing products, registering service, and/or any privileges as specified on the myAIS application, the Subscriber may have to fill in accurate and up-to-date information for identity verification and to inform the requirements of conducting any transaction. This includes agreeing to comply with the Terms and Conditions and details of subscribing, registering, accessing, ordering products, requesting to use service, or requesting for services or privileges as specified in each list. Notwithstanding, the Service Provider reserves the right to reject any action if users do not adhere to the specified guidelines, or cannot prove their identity, or do not have the right to access the requested information or services.

4. Subscriber certifies that any information given to use myAIS and the electronic transactions conducted in myAIS are true and correct in all respects and can be used as evidence. If it is found that such information is false, incorrect, out-of-date, and incomplete or is not the real information of the Subscriber, the Service Provider shall be entitled to immediately suspend, cancel any Services to the Subscriber or reject the use of service of Subscriber.

5. myAIS has been operated in Thailand. If the Subscriber accesses (log in) or uses myAIS Application outside Thailand, the Subscriber agrees and consents to be governed by Thai Laws.

6. All information appearing on myAIS including trademarks, service marks, and so on are the intellectual properties of the Service Provider and/or the Service Provider is licensed to use.

7. Subscriber acknowledges that his/her personal data or any information given to use myAIS including the electronic transactions conducted in myAIS will be sent via the internet network which is a public network. The Service Provider of myAIS will use its efforts and be precautions to prevent any third person from accessing to such information following the cyber security measures. 

8. Subscriber agrees that the Service Provider shall not be responsible for any damages that occurred due to using any services on myAIS or any Service Provider acting on the information received, Illegal access, use, Data Breach, or any reason unless such event has arisen from fraud or gross negligence of the Service Provider.

9. Subscriber agrees to the use of myAIS that Subscriber shall not perform any inappropriate or illegal activity, or against good morals, culture, and tradition or against the regulations, rules, or any orders which are currently or in the future applicable through myAIS, and any violation of which shall entitle the Service Provider of myAIS to suspend the use of myAIS, the Mobile Phone Service and any other services forthwith.

10. Subscriber acknowledges and agrees that in case myAIS has channels for payment of products and/or service charges, myAIS Application is only a channel connected to the service system or the website of the bank and/or the issuer of the credit card and/or the electronic payment service provider and/or LINE Pay Service provider, or other that may be introduced in the future. Any act which results in the deduction or collection from the bank accounts or credit card accounts or electronic money account or any accounts or any credit card bond to LINE Pay Service is subject to the Terms and Conditions between the owner of the bank account or the credit card holder and the said bank and/or the issuer of the credit card and/or the electronic payment service provider and/or LINE Pay Service provider, or other that may be introduced in the future.

11. The Terms and Conditions are used in conjunction with the Terms and Conditions of services which the Subscriber has purchased or subscribed for the use. Apart from the Terms and Conditions, any electronic transactions of Subscriber performed through myAIS which are connected to the system of any service provider shall also be subject to the Terms and Conditions of such service provider.

12. Any transaction conducted on myAIS Application using a User Account (myID) and Personal Identification Number (PIN), whether performed by the Subscriber themselves or by an authorized representative of the Subscriber, or anyone who with or without intent, uses such User Account (myID) and PIN, will be deemed binding on the Subscriber. If the transaction involves service charges, fees, expenses, or damages resulting from such transactions, the Subscriber, as the owner of the User Account (myID) and PIN, remains responsible for all transactions, without the right to dispute or claim for the service provider to indemnify any damages whatsoever. 

Notwithstanding, Subscribers should note that using myAIS may not necessarily require a login with a User Account (myID) and PIN each time. However, Subscribers are recommended to log out for security reasons after each use of myAIS.

13. Subscribers shall be precautious and protect the User Account (myID) and personal identification number (PIN) as confidential information, and shall not transfer, consent, or assign the right to use the User Account (myID) and PIN, or access to myAIS for others. If a Subscriber becomes aware that someone else accessed the User Account (myID) and/or PIN without permission, the Subscriber shall immediately notify the Service Provider.

14. The Subscriber shall have the capability and/or lawful authority to apply for the use of any services via this myAIS Application and the Subscriber shall pay for the goods/service purchased or subscribed to the Service Provider.

15. Obligations and responsibilities of Subscriber:

15.1 To acquaint with the method and process to access and perform any transactions on myAIS and strictly comply with this Terms and Conditions including those to be adjusted and/or added in the future;

15.2 To take care and be responsible for and inform agents and persons under the responsibility of Subscriber to acknowledge and strictly comply with the Terms and Conditions;

15.3 To fully cooperate with the Service Provider or the authorized representative of the Service Provider to protect the Computer System from damages;

15.4 To immediately inform the Service Provider of any improper use of or wrongful access to or using information or any act that interferes with the use of myAIS; or

15.5 When using the computer or any equipment to access myAIS, the following practices shall be complied with:

(1) Designated Personal Identification Number to Lock screen Password in case the Computer System is not in use, so as to protect illegal access to the system;

(2) Regularly inspect and take caution in every inputting computer data to the Computer System, and always update the Anti-Virus program;

(3) Switch off the computer, any equipment, and the peripheral equipment when not in use for a long period of time or when finishing the work.

15.6 Keep the PIN in confidence, do not share with others, set a PIN carefully, do not use the same PIN or easy to guess or use the same PIN in every process when using the Computer System or every Computer System which is authorized to use, and change the PIN at a suitable period of time or when there is an appropriate situation.

15.7 To ensure and be responsible that its agents and persons under the responsibility of Subscriber shall not violate the following prohibitions, and should there be any violation of such prohibitions, Subscriber shall jointly be liable for both civil and criminal offenses with such offender according to relevant law:

(1) Change the computer data without permission of the Service provider.

(2) Disclose or distribute the computer data to others either for personal or other’s interest without permission which results in damages to the Service Provider.

(3) Negligently or carelessly use the Computer System in such a way that causes others to be able to obtain and disclose or distribute the computer data.

(4) Use other persons’ Password to access the Computer System to read, copy, change, delete, or destroy the computer data or to perform any transactions either for personal or other person’s interest.

(5) Harass or destroy the computer data or the Computer System to cause damages to the Service Provider or to others.

(6) Keep watching on, searching for, or decoding the electronic data by using any equipment or technology to obtain the computer data or the confidential information of the Service Provider or the others with the intent to cause damage to the Service Provider or the others.

(7) Assist or cooperate with the others to access the Computer System or the computer data to read, copy, change, delete, or destroy the computer data or to perform any transaction either for personal or the others’ interest.

(8) Use the Password which is used for accessing the Computer System and cause damages to the Service provider or the others.

(9) Negligently or carelessly use the Password or allow others to use their own Password to access the Computer System.

(10) Attempt to access the unauthorized part of the Computer System.

(11) Install, having in possession of, or use the hacking tools software.

(12) Connect the computer equipment or any electronic device with the Computer System without permission of the Service Provider.

(13) Access the Computer System in any wrongful manner.

(14) Commit any offense as prescribed in the Computer Crime Act B.E.2550 and any other relevant laws.

16. Subscriber shall be responsible for the internet connection to access myAIS according to the Terms and Conditions at its own cost.

17. Subscriber shall procure the necessary equipment for the internet connection with myAIS.

18. Subscriber agrees and acknowledges that the Service Provider shall not be liable, either directly or indirectly, for any loss or damages arising from Subscriber’s use of myAIS including any other damages such as the damages from the use or non-use of Mobile Phone Service, unless otherwise stated by relevant laws and/or this Terms and Conditions for myAIS.

19. Should any of the Terms and Conditions be considered invalid or unenforceable, it shall be deemed that those Terms and Conditions are void only to the extent of those being invalid or unenforceable without affecting the other Terms and Conditions which still be in full force and effect.

20. Subscriber acknowledges and agrees to the Service Provider to collect, use, and process Subscriber’s personal data e.g., full name, address, telephone number, usage behavior, etc. for the purposes of providing the myAIS service, improving service efficiency, and communicating information about various privileges to Subscribers. This may include the necessity to transfer or disclose such information to companies within the AIS group or partner companies under contractual or legal relationships, as well as cloud platforms located in foreign countries. These actions are taken to provide myAIS service and to serve the interests of Subscribers in choosing to subscribe and/or purchase products/services as selected by the Subscribers. Such data will be protected in accordance with the Personal Data Protection Notice https://www.ais.th/privacy-notice/en/.

21. The Service Provider may engage in public relations advertising for its own products and services, as well as for products and services of Advanced Info Service Public Company Limited and its business partners, to Subscribers through myAIS.

22. The Service Provider has the right to cancel myAIS, including services on myAIS. The Service Provider will notify in advance on myAIS or through other channels as specified by the Service Provider.

23. If the Subscriber fails to comply with this Terms and Conditions or any Terms and Conditions which have been made with the Service Provider, the Subscriber allows the Service Provider to suspend and/or cancel the use of myAIS without prior notice to the Subscriber.

24. In the event that the Subscriber wishes to change, suspend, and/or cancel myAIS, by complying with the process and procedure as prescribed by the Service Provider, and upon having completely changed, suspended, and/or canceled by the Service Provider of the use of myAIS to Subscriber, it shall be deemed that all letters, documents and/or computer data which Subscriber sent to the Service Provider for such purpose is the integral part of this terms and Conditions.

Subscriber hereby read and understood the Terms and Conditions for myAIS and shall be deemed to have accepted the conditions as prescribed in the above Terms and Conditions in all respects. If the Subscriber does not accept the Terms and Conditions, the Subscriber may not have access to myAIS service.

 

The Terms and Conditions of Use for myID

The Terms and Conditions for the use of myID (“the Terms and Conditions”) apply to AIS mobile phone Subscribers, including both postpaid and prepaid Subscribers, a Fixed Broadband Service Subscribers such as AIS Fibre or that will be added in the future, and other general individuals who register for myID and use myID in accordance with the specified Terms and Conditions.

The Terms and Conditions define the details, procedures, rights, and responsibilities associated with myID usage. The individuals who desire to use myID are recommended to thoroughly read and understand the Terms and Conditions before accepting and using myID.

The use of myID is solely performed under the User’s desire, and the User willingly accepts and complies with the Terms and Conditions. In case the User desires not to accept the Terms and Conditions, the User will not be able to use myID and the User can cease to perform in any procedures immediately.

In the event that the Users have agreed to use myID, it shall be deemed to be bound by the Terms and Conditions. Terms and Conditions may be modified or amended appropriately to ensure compliance with relevant laws or regulations. If any modifications or amendments are made, notification will be provided through the myAIS Application or by other specified methods. Users agree to comply with any additional Terms and Conditions until they decide to discontinue the use of myID.

1. Definitions
"myID" means the user account for accessing the myAIS Application. myID is used for various purposes, such as accessing myAIS for checking and viewing information related to AIS mobile phone services, AIS Fibre, using or receiving privileges, redeeming points, purchasing products/services, and more.

"Company" means Advanced Wireless Network Company Limited.

"Users" means individuals who use myID to access the myAIS Application or other Applications that may be made available in the future. Users use and register their mobile phone numbers and/or email and agree to comply with the Terms and Conditions.

"OTP: One Time Password" means a single-use password, in the form of letters, characters, numbers, or other symbols generated by the Company and sent via SMS to the mobile phone number or email used for myID registration. It is used to establish a relationship and confirm the User's registration with myID.

"Personal Identification Number (PIN)" means the code created by the User to be used in conjunction with myID. It is typically a 6-digit numeric PIN, but the Company may introduce other formats in the future.

2. Creating myID

2.1 Users must register myID through the myAIS Application, or any other channels as specified by the Company.

2.2 To register for myID, Users are required to provide their mobile phone number and/or email. The Company will authenticate your information by sending the OTP to the mobile phone number and/or email. Users are responsible to keep the OTP strictly confidential and do not share to others in order to prevent it from being misused. In the event that the register of myID process is verified by using the OTP, the Company will consider this transaction as the actions of the actual User.

2.3 After the Company verifies the User’s identity, Users will then be required to create and set their own PIN. Once the registration process is complete, Users can immediately use myID to access the various services provided on the myAIS Application.

2.4 In the event that Users cannot remember the PIN, Users have the option to request or change the PIN by themselves through the myAIS Application or any other channels as specified by the Company.

3. User Rights and Responsibilities

3.1 Users must keep the myID or other any code that identifies the User’s identity confidential and are prohibited from allowing any person to use the myID under any circumstances. Users cannot transfer or assign ownership of their myID to any other person.

3.2 Users acknowledge that logging in with myID and PIN to access any services provided by the Company allows continuous access without the need for repeated logins. However, Users are recommended to log in with myID and set a new PIN every 3 months.

3.3 Any transactions made using myID and PIN, whether performed by the User themselves, an attorney, or any person to whom the User has given permission to use myID and PIN, or any unauthorized person who uses myID and PIN, whether intentionally or negligently, the said transactions are considered to be valid and complete and binding on the actual User. If a transaction involves any charges, fees, or expenses, or if it causes any losses, the User, as the owner of myID, is responsible for such transactions in every aspect and cannot dispute or claim compensation from the Company.

3.4 Users have a duty to immediately inform the Company if they found or have reason to believe that their myID has been used by someone else or that there has been unauthorized access to their myID. Users can report such incidents by contacting AIS Contact Center at 1175, 24 hours a day, every day. The Company will take prompt actions to assist. To enhance the security of using myID, the Company recommends that Users create a complex and hard-to-guess PIN, which is used exclusively with the myID.

3.5 Users who are Subscribers or present themselves as Subscribers of AIS mobile phone services, including both postpaid and prepaid Subscribers, Subscribers of AIS Fibre a Fixed Broadband Service, or other services that may be introduced in the future are allowed to add the numbers to use within their myID, subject to the conditions, procedures, and methods specified by the Company. The Users agree that they are solely responsible for all actions and transactions carried out through their myID.

3.6 Users agree and acknowledge that the Company shall not be liable for any damage caused to Users arising from the use of myID, unauthorized access, use or hacktivism, or for any reason, unless in case of deception or gross negligence or willful misconduct on the part of the Company.

4. Cancellation

The Company may suspend or terminate Users’ myID immediately in the following cases:

4.1 The Company found that the mobile phone number’s owner/ holder has been changed, or the number has been terminated or disconnected from AIS database.

4.2 The Users request to cancel the use of myID.

4.3 The Users no longer have a registered mobile phone number, email, social media account, or Fixed Broadband Service number used with myID in the system.

4.4 The Company terminates the myID service, with advance notification through the myAIS Application or other channels as specified by the Company.

5. Protection of Personal Data

Users agree to allow the Company to collect, use, or disclose personal data, including behavior related to using services with myID, for the purpose of service provision and service efficiency improvement, communication, offering various privileges to Users and may involve the necessity to transfer or disclose such data to AIS Group or the Company’s partners as the counterparties or legal relations according to the law, as well as cloud platforms located overseas. This is done for the purpose of providing myID services and/or for the benefit of Users in selecting and/or purchasing products/services as per the Users' preferences. All such data will be protected according to personal data protection standards and in accordance with the Privacy Policy of the Companies in AIS Group https://www.ais.th/privacy-notice/en/.

The Users have read and thoroughly understood the Terms and Conditions of use myID and shall be deemed to have accepted the conditions as prescribed in the above Terms and Conditions in all respects. If the Users do not accept the Terms and Conditions, the Users may not access to use the myID service.
